These Terms of Use govern your access to and use of the Foundation Health MD PLLC website, including its pages, content, forms, links, and other public-facing features. In these Terms, “Foundation Health,” “Practice,” “we,” “us,” and “our” refer to Foundation Health MD PLLC.
By accessing or using this website, you agree to these Terms of Use. If you do not agree, please do not use the website.
1. Acceptance of Terms
These Terms apply only to your use of the public Foundation Health website. Medical services, patient communications, payments, and other aspects of an established physician-patient relationship may be governed by separate patient agreements, consents, financial policies, Medicare documents, and our Notice of Privacy Practices.
If another written agreement between you and Foundation Health conflicts with these Terms, the other agreement will control with respect to the subject it addresses.
2. Medical Information, Physician-Patient Relationship, and Emergencies
Information on this website is provided for general educational and informational purposes only. It is not individualized medical advice, a diagnosis, or a treatment recommendation, and it is not a substitute for care from a qualified healthcare professional who knows your medical history.
Do not use website information to start, stop, or change a medication, treatment, diet, exercise program, or other health-related decision without appropriate professional guidance. Do not delay seeking medical care because of information you have read or viewed on this website.
Use of this website, submission of a contact form, attendance at a lecture, participation in a general-audience question-and-answer session, scheduling request, payment, or automated confirmation does not by itself establish a physician-patient relationship.
A physician-patient relationship may be established only after Foundation Health has reviewed and accepted an individual for care and the required clinical intake, consent, and agreement process has been completed.
This website, its contact forms, ordinary email, online scheduling tools, and patient portal are not intended for emergency assistance. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department.
Foundation Health is not an emergency service and does not provide continuous monitoring, emergency response, or around-the-clock on-call coverage. Messages may not be reviewed immediately.
3. Telehealth Services
Telehealth services are available only when Foundation Health is legally permitted and clinically able to provide care in the jurisdiction where the patient is physically located at the time of the appointment.
You are responsible for providing accurate information about your identity and physical location.
Foundation Health may decline, postpone, or discontinue a telehealth encounter if your location cannot be verified, Foundation Health is not authorized to provide care in that jurisdiction, telehealth is not clinically appropriate, or an in-person examination, emergency evaluation, or other level of care is needed.
A website statement that telehealth may be available in a particular state does not guarantee that services will be available to every individual or for every condition.
4. Services, Scheduling, Pricing, and Insurance
Descriptions of services, programs, memberships, appointment lengths, availability, and prices are provided for general information and may change at any time.
Website information does not constitute a binding offer, guarantee of acceptance, or promise that a particular service is appropriate for you. Foundation Health may decline to establish or continue a physician-patient relationship when permitted by law and professional standards.
Appointments are not final until confirmed through the Practice’s designated scheduling system.
Cancellations, rescheduling, refunds, memberships, recurring charges, and other payment matters may be governed by separate policies or agreements presented during scheduling or intake.
Foundation Health does not guarantee that any service will be covered or reimbursed by Medicare, Medicare Advantage, commercial insurance, a health savings account, a flexible spending account, an employer, or another third party.
Any Medicare-specific requirements, including a private contract when applicable, will be addressed through separate written agreements before services are provided.
5. No Guarantee of Results
Health outcomes vary among individuals.
Foundation Health does not guarantee that any consultation, program, recommendation, lifestyle change, educational resource, or other service will prevent, reverse, cure, or diagnose a particular condition; produce a specific health, laboratory, weight, fitness, longevity, or quality-of-life result; or eliminate the need for medication, specialist care, emergency care, or other medical treatment.
References to research, expected benefits, examples, patient experiences, or potential outcomes are not promises or guarantees of individual results.
6. Foundation Health and Skyterra Wellness
Foundation Health MD PLLC is an independent medical practice.
Skyterra Wellness LLC does not own or control Foundation Health, direct its medical judgment, maintain its medical records, determine patient eligibility, or control diagnosis or treatment.
References to Skyterra on this website describe the Practice’s location, educational activities, or other permitted relationship. They do not create a partnership, joint venture, employment relationship, agency relationship, or shared responsibility for clinical care.
Foundation Health is responsible for the medical services it independently provides. Skyterra is responsible for its own programs, facilities, personnel, and operations.
7. Privacy and Electronic Communications
Your use of this website is also subject to our Website Privacy Policy.
If you become a patient or provide protected health information in connection with healthcare services, our use and disclosure of that information are also governed by our Notice of Privacy Practices and applicable law.
Do not submit detailed medical histories, photographs, medical records, Social Security numbers, payment-card information, or other sensitive information through a general website contact form unless the form specifically states that it is intended and secured for that purpose.
Established patients should use the secure Practice Better patient portal for sensitive clinical communications whenever reasonably available.
Ordinary email and website communications may not be continuously monitored and may not provide the same safeguards as the secure patient portal. Sending a message does not guarantee that it has been received, reviewed, or acted upon.
You are responsible for providing accurate information and for ensuring that you have authority to submit any information concerning another person.
8. Third-Party Services and Links
The website may link to or integrate with third-party services, including Practice Better, payment processors, scheduling platforms, laboratories, pharmacies, imaging facilities, specialists, social-media platforms, educational resources, and other external websites or services.
Third-party services are governed by their own terms, privacy policies, security practices, and availability requirements.
A link does not necessarily constitute an endorsement of all information, products, services, or opinions provided by the third party.
Foundation Health does not control third-party websites or platforms and is not responsible for their independent content or operations, except to the extent responsibility cannot lawfully be excluded.

Unless otherwise stated, the content on this website is owned by, licensed to, or used with permission by Foundation Health MD PLLC. This includes text, branding, photographs, graphics, videos, audio, presentations, handouts, downloads, and educational materials.

Changes to separate patient agreements, privacy notices, financial policies, or clinical policies will be handled according to those documents and applicable law.
13. Governing Law, Severability, and Waiver
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
To the extent a dispute relates solely to website use and is not subject to another controlling agreement, the parties consent to jurisdiction in the appropriate state or federal courts serving Transylvania County, North Carolina.
Nothing in this section alters any venue, forum, or procedural rights that cannot legally be modified.
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
A failure by Foundation Health to enforce a provision does not waive the right to enforce that provision later.
